Terms of Service

1. Who we are and what these terms cover

Orqanova is provided by Vladimir Maslov, an independent developer based in the Republic of Moldova — a private individual, not a company (“we”, “the operator”). The service has no legal entity; these terms are an agreement with this individual. Contact: hello@orqanova.com.

By creating an account or using the service you accept these terms and the Privacy Policy. If you do not agree, do not use the service.

2. What the service does

Orqanova is a platform for creating short videos with AI: scripts, frames, voice-overs, editing, a “brand memory” with your materials, research of competitors’ public accounts and monitoring of your own accounts. Part of the work is done by external services and AI models; they are listed in the Privacy Policy. The set of features may change.

3. Account and age

Registration requires an email address, a password and confirmation with a code sent by email. You are responsible for keeping your password safe and for everything that happens in your account. Use only your own email address.

You must be at least 18 years old to use the service. It is not intended for anyone under 18.

4. Credits and payment

Paid operations (generating images, video, voice-overs, editing, etc.) are paid with internal credits. Credits are topped up by paying in cryptocurrency through Cryptomus; we do not accept or store bank card data. The service itself shows the cost of operations. An operation performed by an external provider is paid for when it runs, even if you do not like the result.

Credits are non-refundable, except where a refund is expressly required by law. Credits have no expiry date.

5. Your content and your responsibility for it

Content you upload (photos, documents, texts, audio, video) remains yours. You grant us the right to process it as needed to run the service: to store it, to send it to external services and AI models when you use the corresponding features (listed in the Privacy Policy), and to create results from it.

You are solely responsible for the content you upload, generate and publish. You confirm that you hold all necessary rights to the materials you use — including music, images, video, voices, and images of people — and that using them does not infringe the rights of third parties. You are responsible for the consequences of publishing any material created with the service.

Results generated for you belong to you, subject to the terms of the AI model providers used to create them. You remain responsible for the rights to the source materials (photos, music, voices, images of people).

6. Photos of people and voices

Photos of people that you upload are sent to generative models (recipients are listed in the Privacy Policy). Therefore you undertake to:

• upload only photos of yourself or of people who have given you explicit consent to such use, including AI processing and creating images and videos from it;
• not create material with them that misleads, presents fiction as a real statement or action of a specific person without that person’s consent, or demeans or defames them.

The service does not clone the user’s voice; voice-overs use voices from an external service’s catalog.

7. Competitor research, social networks and platforms

You may add public accounts for research; on your command we obtain their public data from providers (details in section 6 of the Privacy Policy). You are responsible for using this data lawfully: for analysis and inspiration, not for harassment, identifying individuals, mass messaging or copying other people’s content.

You are responsible for your own social network accounts and for any access you grant to them. You must comply with the rules and terms of every platform where researched content is published or where you publish results. We are not responsible for the actions of platforms, including account restrictions or blocks, rejected or removed publications, delays, and changes to their rules or APIs.

8. What you must not do

• break the law or violate the rights of others, including copyright and image rights;
• create material that impersonates another person or organization, or deceive an audience;
• create sexual material involving minors, or material inciting violence or hatred;
• upload other people’s personal data without a lawful basis;
• try to access other accounts or data, disrupt the service, or bypass rate limits and credit accounting;
• resell access to the service.

For violations we may restrict or close access.

9. AI-generated material and external services

Materials are created with the help of AI. Results may be inaccurate, resemble existing material, or not match your expectations. You must review every result before using or publishing it. We work through external providers whose own terms may also limit what can be created; we do not control their operation or rules.

We do not guarantee any result of using the service or of publishing the material: reach, views, engagement, followers or sales.

10. Availability and limitation of liability

The service is provided “as is” and “as available”, without warranties of any kind and without a guarantee of uninterrupted operation, absence of errors or preservation of your content; keep important results yourself. To the extent permitted by applicable law, we are not liable for indirect or consequential losses, lost profit, the actions of external providers and platforms, or the consequences of using or publishing generated material, and our total liability for any claim is limited to the amount you paid for the service.

This section concerns your content and your use of the service. It does not limit our own responsibility for protecting the personal data we process, which is set out in the Privacy Policy.

11. Account deletion and termination

You can delete your account yourself (confirmation code sent to the account’s email) or request deletion by email — what is deleted and what remains is described in the Privacy Policy and on the Data Deletion page. We may close access if these terms are violated. An unused credit balance is not refunded when the account is deleted.

12. Changes, disputes, contact

We may change these terms; the current version is always on this page, with the date at the top. By continuing to use the service after a change you accept the new version. Send any questions and disputes first to hello@orqanova.com. These terms are governed by the law of the Republic of Moldova. Disputes are first attempted to be resolved by negotiation; failing that, they are brought before the courts at the operator’s location.
